reporting obligation
Anyone who stays as a guest in an accommodation facility must register immediately, but in any case within 24 hours of arriving at the accommodation facility. Registration is complete as soon as the accommodation facility has been informed of the name, date of birth, gender, nationality, country of origin and address including postcode and - in the case of foreign guests - the type, number, date of issue and issuing authority of the travel document and the person required to register has confirmed the accuracy of the data with their signature. As soon as the accommodation is vacated, the guest must be deregistered by making a corresponding entry in the guest register. People who live in a family unit (family, life partners, registered partners) are not subject to this registration requirement if at least one of them registers as a guest and provides the name and date of birth of their fellow travelers. Likewise, people in a travel group of at least eight guests, with the exception of the tour guide, are exempt if the tour guide presents a collective list containing the names and nationalities and - in the case of foreign guests - the type, number and issuing authority of the travel document of these guests to the accommodation provider or their representative when taking up accommodation and confirms the accuracy of the information with his/her signature. The latter only applies if the travel group does not stay together in the same accommodation facility for longer than two weeks.
The owner of the accommodation facility or their representative is responsible for making entries in the guest register. They must inform those affected of the obligation to register. If a person required to register refuses to comply with the obligation to register, the owner of the accommodation facility or their representative must immediately notify the registration authority or a public security agency.
The registration authority and the public security service bodies must be granted access to the guest register at any time upon request. In the case of automated processing, written copies of the guest register must be provided upon request or the data must be transmitted remotely.
