General Terms and Conditions

1. General

Urban Flats Vienna – Edward Matar e.U. rents furnished apartments to private and corporate clients.
The rental object is an apartment with the associated furnishings. Each apartment has its own inventory list including all movable items and the replacement prices in case of loss or damage.

2. Booking

To complete a booking, the following information is required: arrival date, departure date, number of arriving persons, apartment type, method of payment, and prepayment (see item 2.4).

With the conclusion of a booking at Urban Flats Vienna, a standard short-term rental agreement is formed between Urban Flats Vienna – Edward Matar e.U. and the person making the booking. The person making the booking is considered the guest, unless they state that they are acting on behalf of a third party. Apartment type, price per night, rate type, and rental duration are defined in the booking.
Due to the short rental period, no security deposit is required.

2.1 Changes to the Booking

Shortening the stay will be charged in accordance with the cancellation policy.
Extensions of the stay may be made depending on availability under the same booking conditions.

2.2 Rates

Unless otherwise stated, all prices include 10% VAT but exclude the 3.2% local city tax¹ and the final cleaning fee of EUR 30.
The payment of the nightly rate includes proportional operating costs, gas, electricity, TV, internet, and use of the elevator.

Refundable Rate – offers the guest the advantage of cancellation under the applicable cancellation policy, with refunds depending on the cancellation time.

¹ Tourism tax for Vienna, calculated at 3.2% of the net accommodation amount.

2.3 Cancellation Policy

For the non-refundable rate, cancellation is excluded.

Non-refundable Rate – is a discounted rate for which the guest waives the right to cancel. The total amount of the booking is due on the day of booking. If payment is not made or not made on time, no booking is considered to have been concluded, and the guest has no entitlement to compensation.

2.3.1 Refundable Rate

  • Cancellations and changes up to 14 days before arrival are free of charge.

  • Cancellations and changes up to 7 days before arrival are charged at 30% of the total booking price.

  • Cancellations and changes up to 3 days before arrival are charged at 60% of the total booking price.

  • Later cancellations, as well as no-shows, are charged 100% of the total amount.

2.4 Prepayment

Non-Refundable Rate

The total booking amount (including final cleaning and local tax) is due on the day of booking.

2.4.1 Refundable Rate

A prepayment of 100% of the first two nights is due on the day of booking.
The total booking amount must be paid no later than 3 days before arrival.

2.5 Accepted Payment Methods

Standard payment methods:

  • Credit card: Visa, MasterCard, Amex

  • Bank transfer

  • Cash

Urban Flats Vienna does not accept foreign currencies (Euro only) or checks.

3. Arrival and Departure

3.1 Check-in

Check-in is available from 14:00 on the day of arrival. Early check-in must be requested and confirmed by Urban Flats Vienna.
If an early check-in is not requested, Urban Flats Vienna cannot guarantee that the apartment will be cleaned and ready.

A guaranteed early check-in cannot be provided.
Check-in from 14:00 may be extended to 15:00 if necessary due to unforeseen circumstances.

In case of a delay caused by Urban Flats Vienna, the guest is entitled to a complimentary extension of their check-out time until 12:00.

3.2 Guest Registration Form

Under Austrian registration law, every arriving guest must complete and sign the guest registration form truthfully upon arrival. The form is placed in the apartment.

3.3 Check-out

The apartment must be vacated, and the key returned by 11:00 on the day of departure.
A late check-out must be requested and approved by Urban Flats Vienna.
If this is not done and the apartment is not vacated by 11:00, another night will be charged.
Depending on availability, a paid late check-out (until 19:00, half the nightly rate) may be booked.

4. Keys

4.1 Key Handover

The key handover is carried out by appointment in front of the apartment. The guest must inform Urban Flats Vienna in good time of the arrival time and contact Urban Flats Vienna by email or telephone.

4.2 Key Return

Keys must be returned to the key return box (in the apartment) on the day of departure.
For lost keys, Urban Flats Vienna charges €150 per set for replacement.

If the guest locks themselves out, Urban Flats Vienna must be notified immediately.
If the incident cannot be resolved by a staff member, a locksmith will be called by Urban Flats Vienna. Costs will always be borne by the guest, even if the guest calls a locksmith themselves, as Urban Flats Vienna bears no responsibility.

5. Cleaning

Urban Flats Vienna charges €30 as a final cleaning fee for each booked apartment.
There is no daily cleaning service during the stay, nor is such service offered.
If staff are encountered in the building, they are neither responsible nor obligated to fulfill special or additional requests.

5.1 Exceptions

For stays longer than 1 month, a weekly cleaning (1x per week) is included.
The tenant/guest may waive this service if desired.

6. Inventory

Each apartment has its own inventory list detailing all movable items and the replacement prices in case of loss or damage.

6.1 Damage to Inventory

If Urban Flats Vienna determines after departure that items from the inventory list are missing or damaged, the corresponding amount will be charged.
For fixed installations or movable furniture that is damaged, the cost of repair or restoration to the original condition will be charged.

6.2 Lost & Found

Personal items left behind will be stored for 2 weeks after departure and then disposed of.
During this time, the guest may reclaim or collect forgotten items; upon request, they can be shipped at the guest’s expense.

7. Other Provisions

Guests are required to follow the house rules. If these are not followed, the landlord reserves the right to charge for any inconveniences or damages resulting from non-compliance.

Non-applicability of the Austrian Tenancy Act (MRG):
The tenant/booking party explicitly acknowledges that the rental relationship is not subject to the provisions of the Austrian Tenancy Act (MRG), and therefore the tenant does not receive the protections established therein.

Use of the Rental Property / Tenant Maintenance Obligations:
The rental property may only be used for residential purposes, specifically as a secondary residence. Any change of purpose requires prior written approval by the landlord. Establishing a “primary residence” or “habitual residence” in the rental property is not permitted.

If the tenant discovers any pest infestation, they must immediately take all necessary and appropriate pest control measures and inform the landlord.

It is expressly stated that the tenant bears the full obligation for maintenance and upkeep pursuant to § 1096 para. 1 ABGB.
The tenant must use the rental property, including the inventory, carefully and properly, maintain it regularly and professionally at their own cost, keep it clean, and repair any damages at their own expense or have them repaired by the landlord at their own cost.
This mainly concerns furniture, dishes, and everyday household items, excluding structural components (heating, sanitary installations, water connections, etc.).

The tenant waives the right to early termination of the rental agreement for the reasons stated in § 1117 ABGB.
